1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I understand that participation in indoor golf and golf
simulator activities involves risks.
These risks may include, but are not limited to:
– Being struck by a golf club, golf ball, or other equipment.
– Injuries caused by swinging clubs or other participants.
– Slips, trips, and falls.
– Contact with simulator screens, walls, flooring, furniture, or equipment.
– Strains, sprains, or other injuries resulting from physical activity.
– Damage to personal property.
I knowingly and voluntarily assume the ordinary risks associated with my participation in the league and use of the facility and equipment.
2. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by California law, I release and hold harmless Los Cabos Golf and its owners, employees, agents, representatives,
and affiliated parties from claims arising from my voluntary participation in the Wednesday Night Golf League or use of the facility and equipment,
including claims arising from ordinary negligence, except to the extent such a release is prohibited by law.
This waiver is not intended to release claims that cannot legally be waived under California law.
3. SAFETY AND FACILITY RULES
I agree to:
– Follow all posted and verbal safety instructions.
– Remain outside another player’s hitting area while that player is swinging.
– Never intentionally hit a golf ball except from the designated hitting area toward the simulator screen.
– Use golf clubs, balls, launch monitors, simulators, and other equipment appropriately.
– Stop playing if instructed to do so by Los Cabos Golf staff.
– Conduct myself in a manner that does not endanger other players, employees, guests, or property.
4. DAMAGE TO PROPERTY
I understand that I may be held financially responsible for damage to Los Cabos Golf property or equipment caused by my intentional misconduct,
reckless conduct, or misuse of equipment, to the extent permitted by law.
5. ALCOHOL AND IMPAIRMENT
I understand that alcohol consumption can increase the risk of injury.
I agree not to participate in golf activities while impaired to a degree that makes participation unsafe. Los Cabos Golf reserves the right to stop any
participant from playing when staff reasonably believes that continued participation presents a safety risk.
Nothing in this agreement is intended to waive liability that cannot legally be waived.
6. PHOTO AND VIDEO RELEASE – OPTIONAL

[ ] YES, I authorize Los Cabos Golf to use photographs or videos of me taken during league activities for reasonable promotional purposes, including
social media, advertising, and the Los Cabos Golf website.
[ ] NO, I do not authorize promotional use of photographs or videos in which I am individually identifiable.
7. MEDICAL EMERGENCIES
If I become injured or experience a medical emergency and I am unable to provide instructions, I authorize Los Cabos Golf personnel to contact
emergency medical services on my behalf.
I understand that I remain responsible for my own medical expenses except where responsibility is otherwise imposed by applicable law.
8. ACKNOWLEDGMENT
I acknowledge that:
– I have carefully read this agreement.
– I understand its terms.
– I understand that it affects important legal rights.
– I have had an opportunity to ask questions before signing.
– I am signing voluntarily.
– I am at least 18 years old.
